Cyber Guidelines

Kemerdekaan berpendapat, kemerdekaan berekspresi, dan kemerdekaan pers adalah hak asasi manusia yang dilindungi Pancasila, Undang-Undang Dasar 1945, dan Deklarasi Universal Hak Asasi Manusia PBB. Keberadaan media siber di Indonesia juga merupakan bagian dari kemerdekaan berpendapat, kemerdekaan berekspresi, dan kemerdekaan pers.

Media siber memiliki karakter khusus sehingga memerlukan pedoman agar pengelolaannya dapat dilaksanakan secara profesional, memenuhi fungsi, hak, dan kewajibannya sesuai Undang-Undang Nomor 40 Tahun 1999 tentang Pers dan Kode Etik Jurnalistik. Untuk itu Dewan Pers bersama organisasi pers, pengelola media siber, dan masyarakat menyusun Pedoman Pemberitaan Media Siber sebagai berikut:

1. Scope
  1. 1. Cyber ​​Media is any form of media that uses the internet as a medium and carries out journalistic activities, and meets the requirements of the Press Law and the Press Company Standards set by the Press Council.
  2. 2. User Generated Content is any content created and/or published by cyber media users, including articles, images, comments, audio, videos and various forms of uploads attached to cyber media, such as blogs, forums, reader or viewer comments, and other forms.

 

2. Verification and balance of news.

  1. 1. In principle, every piece of news must undergo verification.
  2. 2. News that could harm another party requires verification within the same news report to uphold the principles of accuracy and balance.
  3. 3. The provisions in point (a) above are an exception, provided that: a. The news genuinely contains an urgent matter of public interest; b. The primary news source has its identity clearly stated, is credible, and competent; c. The subject of the news requiring confirmation is unknown in their whereabouts and/or cannot be interviewed; d. The media provides an explanation to the readers that the news still requires further verification, which is being pursued as quickly as possible. This explanation is included at the end of the same news report, in parentheses and using italics.
  4. 4. After publishing news in accordance with point (c), the media is obligated to continue verification efforts, and once verification is obtained, the verification results are included in an updated news report with a link to the unverified news.

 

3. User Generated Content.

  1. 1. Cyber media is obligated to clearly and conspicuously include the terms and conditions regarding User-Generated Content that do not contradict Law No. 40 of 1999 concerning the Press and the Journalistic Code of Ethics.1
  2. 2. Cyber media requires every user to register for membership and complete a log-in process before being able to publish all forms of User-Generated Content. The regulations regarding log-in will be further stipulated.
  3. 3. During registration, cyber media requires users to provide written consent that the User-Generated Content they publish will: a. Not contain false, slanderous, sadistic, or obscene content; b. Not contain content that includes prejudice and hatred related to ethnicity, religion, race, and intergroup relations (SARA), as well as incite violence; c. Not contain discriminatory content based on differences in gender and language, and will not demean the dignity of the weak, poor, sick, mentally or physically disabled.
  4. 4. Cyber media has the absolute authority to edit or delete User-Generated Content that violates point (c).
  5. 5. Cyber media is obligated to provide a complaint mechanism for User-Generated Content that is deemed to violate the provisions in point (c). This mechanism must be provided in a place easily accessible to users.
  6. 6. Cyber media is obligated to edit, delete, and take corrective action on any reported User-Generated Content that violates the provisions of point (c), as quickly as proportionally possible, and no later than 2 x 24 hours after the complaint is received.
  7. 7. Cyber media that has complied with the provisions in points (a), (b), (c), and (f) is not held responsible for problems arising from the publication of content that violates the provisions in point (c).
  8. 8. Cyber media is responsible for reported User-Generated Content if it2 fails to take corrective action after the time limit specified in point (f).

 

4. Errors, Corrections, and Rights of Reply

  1. 1. Errors, corrections, and rights of reply refer to the Press Law, the Journalistic Code of Ethics, and the Guidelines for Rights of Reply set by the Press Council.
  2. 2. Errors, corrections, and/or rights of reply must be linked to the news that is corrected, rectified, or afforded the right of reply.
  3. 3. The time of publication of the error, correction, and/or right of reply must be included in each news item.
  4. 4. If certain cyber media news is disseminated by other cyber media, then: a. The responsibility of the news-making cyber media is limited to the news published on that cyber media or cyber media under its technical authority. b. News corrections made by a cyber media must also be made by other cyber media that quote news from the corrected cyber media. c. The media that disseminates news from a cyber media and does not make corrections to the news as carried out by the cyber media owner and/or news maker is fully responsible for all legal consequences of the uncorrected news.
  5. 5. In accordance with the Press Law, cyber media that do not serve the right of reply can be sentenced to a maximum fine of Rp 500,000,000 (Five hundred million rupiah).

 

5. Retraction of News.

  1. 1. Published news cannot be retracted due to censorship reasons from parties outside the editorial team, except in cases related to ethnicity, religion, race, and intergroup relations (SARA), decency, the future of children, traumatic experiences of victims, or based on other specific considerations determined by the Press Council.1
  2. 2. Other cyber media are obligated to follow the retraction of news excerpts from the originating media that has retracted them.
  3. 3. The retraction of news must be accompanied by the reasons for the retraction and announced to the public.

 

6. Advertisement

  1. 1. Cyber media is obligated to clearly distinguish between news products and advertisements.
  2. 2. Every news item/article/content that constitutes an advertisement and/or paid content must include a statement such as “advertorial,” “iklan” (advertisement), “ads,” “sponsored,” or other words explaining that the news item/article/content is an advertisement.

 

7. Copyright
Cyber media must respect copyright as stipulated in the applicable laws and regulations.

8. Guideline Inclusion
Cyber media must include this Cyber Media News Guidelines in their media clearly and prominently.

9. Disputes
The final judgment on disputes regarding the implementation of the Cyberspace News Guidelines is resolved by the Press Council.
